Maintaining Medicaid benefits

Case Size:

$60,000 SNT

Summary:

Mike & his wife were involved in a motorcycle accident and Mike sustained significant injuries, including: double amputation of legs, amputation of right hand, and abdominal injuries resulting in a colostomy. Mike received Medicaid and SSI benefits. The insurance policy maxed out at $100,000, in which Mike received $60,000. If Mike received any funds over the $2,000 resource limit, he would lose his means-tested benefits.

Actions:

Ametros placed Mike’s $60,000 into a Special Needs Trust to preserve his Medicaid benefits, but also provide for other needs not covered by government benefits. (A future medical malpractice case also was placed into the SNT for Mike’s sole benefit.)

Results:

If Mike had received the $60,000 directly or mishandled it in the process, his medical benefits and other government assistance could have been jeopardized, severely impacting his future care and comfort.

With all of the moving parts, our team was able to coordinate a plan that would protect Sarah’s means-tested benefit eligibility with the use of a special needs trust (SNT), provide her with resources to assist with monthly allowable payments through an ABLE account, and preserve her Medicare eligibility by professionally administering her allocated future medical funds in the MSA.

Carol was in the workers’ compensation system for a long time, and was grown tired of seeing the doctors within the system. She traveled the country in an RV with her husband, and having to always treat within a certain network limited their travel.

Ametros worked with Leonard’s adjuster to resubmit an MSA to make sure the items he wanted covered would be included. Because Leonard wanted to make sure that he would not have to change providers after settlement, Ametros reached out to his providers directly and made sure they would accept their professional administration service, CareGuard, as form of payment.
